(i) A building or structure in existence prior to the effective date of this code or one for which a lawful building permit was issued for the erection of such building or structure prior to the effective date of this code.
(ii) A building or structure erected in accordance with the 1968 building code under a lawful building permit issued for the erection of such building or structure after the effective date of this code in accordance with section 28-101.4.2 of this code.
